Flexible Structure for Dispute Resolution

Overview

Jupitice ODR offers a flexible structure for resolving disputes through Single-Tier, Two-Tier, or Three-Tier proceedings, allowing parties to choose the approach best suited to their needs.

1. Single-Tier ODR

The dispute is resolved through a single stage, typically by Negotiation, or Mediation, or Arbitration.

2. Two-Tier ODR

  • The dispute begins with Negotiation, and if unresolved, moves directly to Mediation.
  • The dispute begins with Mediation, and if unresolved, moves directly to Arbitration.

3. Three-Tier ODR

The standard ODR process consists of three stages:

  • Negotiation: Parties attempt to resolve the dispute independently.
  • Mediation: If negotiation fails, a neutral mediator assists in reaching a settlement.
  • Arbitration: If mediation is unsuccessful, the matter is escalated to arbitration, where a binding decision is made.

UNCITRAL Compliance

In line with Section IX of the UNCITRAL Technical Notes on ODR, if mediation does not resolve the dispute, the neutral or ODR administrator is expected to inform the parties about the nature and format of the final stage, ensuring transparency and procedural clarity.
